Recently, the FTC proposed a rule banning non-compete agreements for most workers nationwide. Subsequently, a U.S. district court in Texas overturned the ban. Companies in competitive industries are finding it harder to know what can and cannot be done to prevent former employees from entering into direct competition with their former employers using secret information learned during their past employment.
