On June 7, 2023, the U.S. Environmental Protection Agency (EPA) released a final rule on Confidential Business Information (CBI) claims under the Toxic Substances Control Act (TSCA).
SOCMA has developed a members-only resource for submitting a claim of confidentiality for proprietary business reasons. The submission process will follow more specific rules and mandate the submission of additional information.
It requires increased specificity in determining the confidentiality of health and safety information and more explicit rules on content going into public copies of documents.
The rule includes a process for correcting deficient CBI claims and the duration of time the submitter is given to amend and resubmit the claim to EPA.
