SOCMA Signs onto TSCA Coalition Letter

Dear Members of Congress:

We are writing on behalf of the American Alliance for Innovation (AAI) to express support for the Committee’s work to improve the Toxic Substances Control Act (TSCA) and ensure a chemical regulatory program at the Environmental Protection Agency (EPA) that is properly resourced, does not impede or create unnecessary barriers to technological innovation while avoiding unreasonable risks of injury, and supports growth in our manufacturing sector.

The AAI is a coalition of trade associations representing a broad spectrum of the U.S. economy and comprising many sectors, at all points along the chemicals value chain and the advanced manufacturing it supports. Our members worked with Congress during the development and passage of the Lautenberg Chemical Safety Act in 2016 and stand ready to assist your efforts to make improvements to TSCA this year.

We appreciate the discussion draft legislative proposals. Releasing discussion drafts and holding legislative hearings was an important and necessary step. The drafts include provisions that address several areas for improvements our organizations have identified, including:

  • Ensuring timely and predictable reviews of new chemicals
  • Avoiding delays which discourage adoption of innovative and sustainable chemicals
  • Following a risk-based approach to regulating a chemical’s intended use
  • Clarifying the statutory exemption for replacement parts enacted in 2016
  • Providing additional clarity and accountability

Making improvements to TSCA while reauthorizing EPA’s fee authority is important and necessary for Congress to pass this year. Doing so will ensure that EPA has the necessary resources to conduct its statutory requirements, while Congress provides oversight to ensure TSCA works as intended. We encourage you to continue to work collaboratively with stakeholders to enhance this draft language and move this key legislative process forward.
